Terms and conditions
§ 1 Scope
These general terms and conditions apply to all orders placed through our online shop by consumers and businesses.
§ 2 Contracting party
The purchase contract is concluded with:
De Jong Motoren & Getriebe GmbH, Gewerbestraße 12, 26845 Nortmoor, Leer, East Frisia, Germany
Phone: +49 4950 93890, e-mail: info@motoren-dejong.de
§ 3 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the order button you place a binding order for the goods in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.
§ 4 Prices and shipping costs
All prices are in euros and include statutory VAT. Any additional shipping costs are shown separately during checkout. Our engines and gearboxes are securely packed on a pallet and shipped by freight carrier.
§ 5 Payment
Payment is made using the payment methods offered during checkout.
§ 6 Delivery and collection
Delivery is by freight carrier on a pallet to Germany, the Netherlands and the rest of Europe. The delivery time is usually 3–7 working days after receipt of payment. Collection from our premises in Nortmoor is possible by arrangement.
§ 7 Core deposit
For some items a core deposit (Altteilpfand) is charged in addition to the purchase price. It is shown with the respective item and refunded to you promptly after return of the identical, complete old part.
§ 8 Retention of title
The goods remain our property until paid for in full.
§ 9 Warranty
Statutory liability for defects applies. For new goods, the limitation period for claims based on defects is two years from delivery. For used goods, the limitation period is one year from delivery; this does not apply to claims for damages arising from injury to life, body or health, or in cases of intent or gross negligence.
§ 10 Liability
For claims based on damage caused by us, our legal representatives or vicarious agents, we are liable without limitation in the event of injury to life, body or health, in the event of intentional or grossly negligent breach of duty, and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract.
§ 11 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Statutory provisions restricting the choice of law and on the applicability of mandatory rules, in particular of the state in which the customer as a consumer has their habitual residence, remain unaffected.
